Know Your Rights: Assisted Decision Making

.

Know Your Rights has been compiled by Kerry Citizens Information Service which provides a free and confidential service to the public…

Decision making is an integral part of our lives. At different times we make important decisions about our finances, property, employment, accommodation, healthcare and social supports.

Overall, there are five different decision support arrangements for people who have challenges with their capacity and who may need support to make certain decisions. These arrangements are based on the different levels of support that a person requires to make a specific decision at a specific time.

The three types of support arrangements for people who currently, or may shortly, face challenges when making certain decisions are outlines as follows:

Continued below…

.

1. Decision-making assistance agreements allow you to choose which decisions you need help with. It also gives your chosen person the legal recognition to help you to make those decisions for yourself.

Your decision-making assistant does not make decisions for you. Instead, they help you to make your own decisions.

The decision-making assistant can only help with decisions that are included in your decision-making assistance agreement.

This means they will be able to access relevant information and records for you if you have included this task in your agreement. Your decision-making assistant does not make a decision with or for you. They support you to make your own decisions.

2. Co-decision-making agreements allows you choose someone you know and trust as a co-decision-maker to make certain decisions jointly with you. These decisions could be about your personal care, property, or money matters.

After you register your co-decision-making agreement, your co-decision-maker can:

• Support you in coming to a decision together. For example, the co-decision-maker will try to explain complex information to you in clear and simple terms
• Help you to access relevant information and records, for example, contacting your bank or doctor
• Make certain decisions together with you, for example, decisions on your finances
• Make reasonable efforts to ensure any decision is implemented

Your co-decision-maker can only support you with decisions listed in your agreement. They cannot make a decision on your behalf without you – you must always be involved.

Continued below…

.

3. Decision-making representation orders are made by the Circuit Court in situations where you are not able to make a decision for yourself, even with support from another person.

An application by you or someone who has a genuine interest in your welfare for an order must be made to the Court.

If the court agrees that you are not able to make certain decisions for yourself, it can appoint one or more decision-making representatives to make those decisions for you.

A decision-making representation order can be time-limited. It will also limit the powers of the decision-making representative as is appropriate.

The court will list all of the decisions that the decision-making representative can make. This may include decisions about property and money matters, as well as decisions about personal welfare.

When making a decision for you, your decision-making representative must:

• Make every effort to find out your past and present wishes about this specific decision, for example, getting the views of your friends, family and trusted advisors

• Help you to be involved in the decision-making as much as possible

There are two types of arrangements for people who wish to plan ahead for a time in the future when they might lose capacity:

Continued below…

.

1. An Enduring Power of Attorney (EPA) is a legal device that can be set up by a person (the donor) to allow another person (an attorney), to look after their financial or personal affairs, in the event that they no longer have the capacity to do so themselves.

An enduring power of attorney is just one of the legal arrangements you can make in the event you become incapacitated or unable to deal with your affairs.

The attorney’s role is to act on your behalf to make certain decisions if you are unable to in the future. An attorney does not need to be a lawyer.

EPAs do not cover decisions about medical treatment. You can make an Advance Healthcare Directive if you want to make decisions about the medical treatment you get in the event that you lose your capacity.

2. An Advance Healthcare Directive (AHD) is a written statement about the type of medical or surgical treatment you want or do not want, if in the future, you are unable to make these decisions.

An AHD is only used if you lose capacity and you can no longer communicate your wishes yourself. It lets your family, carers and healthcare professionals know your wishes about your medical and surgical treatment if you are unable to make or communicate those decisions yourself.

You can appoint someone you know and trust as your designated healthcare representative to ensure your advance healthcare directive is followed.

All decision support arrangements are registered with & regulated by the Decision Support Service. This is a service that promotes the rights and interests of people who may need support with decision-making. Further information is available at www.decisionsupporservice.ie  or telephone (01) 2119750

Finnegan On Films: Movies On TV To Take You Into 2024

.

Our movie guy, James Finnegan, recommends some films on the box that see out the year and welcome in the new one…

Let’s see what films will lead us gently from 2023 into the New Year

First up is that perennial favourite The Bridge on the River Kwai (Saturday 2.45 RTE1). This Oscar-winning Second World War drama telling the true life story of a British colonel in a Japanese POW camp who is ordered to build the aforementioned bridge over a river, forging a vital communications link.

While refusing at first, he eventually takes the project on becoming so obsessed that the Allies need to destroy it. Directed by David Lean, and starring Alec Guinness, Jack Hawkins, William Holden this is a powerful epic.

Continued below…

.

Jennifer Hudson is well cast as the lead in Respect (Saturday 10pm RTE1), a biopic of the Queen of Soul Aretha Franklin.

Forest Whitaker stars as her father, Baptist Minister CL Franklin, who takes a personal interest in her contract with Columbia Records when none of her singles are hits.

Also starring Marlon Wayans, Audra McDonald, Titus Burgess and Marc Maron, her career takes off when smooth talking Ted White becomes Aretha’s manager.

Classic comedy There’s Something about Mary (Saturday 10.20pm TG4) is the wonderfully over the top romantic comedy directed in the best possible taste (not!) by the Farrelly Brothers.

A lovestruck man sends a sleazy private detective to track down his high school sweetheart to rekindle their brief relationship.  Unfortunately, he is not her only suitor. Starring Ben Stiller, Cameron Diaz, Matt Dillon and Lee Evans, this is a Classic.

Continued below…

.

Another fine comedy is Dirty Rotten Scoundrels (New Years Eve 1.10pm RTE1) where a professional conman is making a career of seducing and swindling wealthy women on the French Riviera.

However, when a brash American hustler arrives looking for a piece of the action, there is conflict and competition.

This is directed by Frank Oz and stars the wonderful Ying and Yang performances of Michael Caine and Steve Martin.

If you are on a cruise today, on New Year’s Eve, you might want to give The Poseidon Adventure (New Years Eve 3.25pm RTE1) a miss, as a luxury liner capsizes when struck by a freak wave, trapping an All Star cast (Gene Hackman, Ernest Borgnine, Shelley Winters and all) in a deadly trial of survival.

Continued below…

.

Michael B Jordan Stars in Tom Clancy’s Without Remorse (New Years Day 9.30pm RTE1), a rather clumsy way of telling us that the creator of Jack Ryan is also involved in this expansion of that universe.

An elite Navy Seal, John Clark (Jordan) sets out to avenge his pregnant wife’s murder, only to uncover a larger international conspiracy.

Two comedies to end with, first Anchorman: The Legend of Ron Burgundy (New Years Day 9.35 RTE2) starring Will Farrell as a chauvinistic 1970’s newsreader who feels threatened by the arrival of an ambitious female reporter (Christina Applegate).

The second is  O Brother, Where Art Thou? (New Years Day 11pm TG4,) the wonderful Coen Brothers comedy, starring George Clooney and John Turturro.

Enjoy and Happy New Year!

Minister for Education, Norma Foley, visited each school in town to meet with the happy teenagers.

• GREAT credit was due to the staff Woodies Tralee as their efforts helped raise €10,770 in this year’s Heroes Campaign.

The campaign came to an end in August after four weeks of fundraising activities which included raffles, bric-a-brac sales and a table quiz. Woodies colleagues all over Ireland have raised more than €300K this year for Heroes, the biggest amount ever.

Tralee Magic Basketball Club News

.

U18 Women’s National Cup 2023-24 Semi-final:

Gurranabraher Credit Union Brunell vs. Tralee Magic

On the 6th of January Tralee Magic U18 Girls team will travel to Corks Parochial Hall, one of Irelands most iconic basketball venues,  to meet Gurranabraher Credit Union Brunell in the home court.

The stage is set for an intense battle in the U18 Women’s National Cup 2023-24 semi-finals.

Both teams come into this match with impressive records, having won incredibly tough previous games in the competition. Both teams enter this semi-finals clash with confidence, having won their last matches.

Gurranabraher Credit Union Brunell emerged victorious against Kilkenny Stars with a convincing 77-53 scoreline, while Tralee Magic overcame Flomax Liffey Celtics in a close encounter, winning 60-57.

Gurranabraher Credit Union Brunell has been dominant in the group stage, scoring an average of 77 points per game while conceding only 53 points.

Their offense has been firing on all cylinders, with seventeen 2-point shots and eleven 3-point shots made per game. However their free throw scoring only hits 47.6%  and could be an area of improvement.

The standout performers for Gurranabraher Credit Union Brunell have  been Mia Lynch,, who scores in their last cup game included five 3 pointers, and Abbie Lyons,  who have been consistent in scoring and making significant contributions to their team’s success.

On the other hand, Tralee Magic has also been in fine form, scoring an average of 60 points per game and conceding 57 points.

Their strength lies in their ability to move the ball quickly and convert 2-point shots, with an impressive 21 shots made per game. However their 3-point shooting could be a concern, having made only 3 shots per game.

The free throw percentage of 75% showcases their efficiency from the  line. Holly O’Brien who scored an impressive 23 points in their last cup game,  and Capped Irish International Lucy O’Connor have been the key players for Tralee Magic, displaying their scoring prowess and making crucial contributions to their team’s victories.

In this highly anticipated matchup, Gurranabraher Credit Union Brunell’s offensive firepower will be a significant advantage, but Tralee Magic’s strong defense and efficient 2-point shooting cannot be underestimated.

The key to victory for Gurranabraher Credit Union Brunell will be their ability to maintain their scoring momentum, but they are up against Tralee Magic’s proven intensive defense which  should limit  Gurranabraher Credit Union Brunells scoring opportunities.

The unquantifiable influence of an enthusiastic home crowd could be the difference in this game.

With three Tralee team’s competing in 3 different national cups on the same weekend in Cork, we would encourage the notoriously  loyal Kerry basketball community will travel Cork to drown out the notoriously vocal Cork support.

Get ready for an exhilarating contest as these two talented teams battle it out for a spot in the U18 Women’s National Cup.

REVIEW 2023: The News From July…

.

Continuing our review of 2023 we look back at some of the news we brought you in July…

• THE Ring of Kerry Charity Cycle was another massive success in early July with around 4,500 setting off from early in the morning on the route.

Thankfully, the sun was shining for the most part and there was a carnival atmosphere at the Beech Road Car Park in Killarney as cyclists arrived home after the gruelling event.

One of them was Anthony ‘Anto’ Cronin, a teacher in CBS The Green, who participated on a penny farthing bicycle in aid of Kerry Mountain Rescue, one of the main beneficiaries of the 41st edition of the event.

• THERE was a great turnout early in the month for the launch of a book from a first-time local author.

‘What Anna Did Next’, was the debut novel by Denise Brassil and her late sister Martha.  Denise’s family and friends gathered in The Rose Hotel where she launched the book and was interviewed on stage by Radio Kerry’s Elaine Kinsella.

It was an emotional afternoon for the Caherslee woman who explained the novel has been over two decades in the making.

• TRUE golfing royalty was present in Tralee Golf Club when Gary Player paid a visit to the Barrow course to play a bit of golf and meet members.

The winner of nine majors also posed next to the statue of the Tralee course’s designer, Arnold Palmer, a friend and contemporary of the South African legend.

• IT was announced a new humanitarian scheme agreed by Government ministers would provide up to €200,000 for small businesses, community, voluntary and sporting bodies who, through no fault of their own, had been unable to obtain flood insurance and were affected by recent floods in Kerry in June.

Flooding occurred in Tralee, Killarney, Listowel and other parts of Kerry last month due to freak rainfall amounts over a short period.

This new scheme will provide much-needed funds to these organisations to carry out essential repairs to their businesses and to return premises to their pre-flood conditions.

Mairead Fernane.

• THERE was great sadness in Tralee in mid-July at the news of the passing of Mairead Fernane. Mairead was a former Chairperson of Austin Stacks GAA Club and a true Rockie to the core growing up in Rock Street.

Mairead was also a Fine Gael Councillor elected to Tralee Town Council in 2009 and served as Deputy Mayor in 2009/10 and 2013/14. Mairead was a prominent local activist for the Tralee Community Hospital and also served with the Kerry Hospice Foundation committee for 15 years, retiring in 2021. In 2005, Mairead founded Victim Assistance, a voluntary organisation which helps victims of crime.

• PLANS for a new five-day festival of family fun and street entertainment in Tralee in August were at an advanced stage.

The name and branding for the new ‘Féile Thrá Lí’ were unveiled on July 17. Féile Thrá Lí, the Tralee StreetFest would take place between August 18-22 to coincide with the Rose of Tralee International Festival.

• THE County League Division 1 relegation playoff battle between Austin Stacks and Kerins O’Rahillys was held on Sunday, July 23  and it was the Blues who prevailed after an epic battle in difficult conditions at Austin Stack Park. They retained their Division 1 status while the Rockies headed down to Division 2.

• SOMEONE scooped the €1 million top prize in a Lotto Plus 1 draw in late July after purchasing their  ticket in Murphy’s Supervalu on Railway Road in Kenmare.

Store owner Derry Murphy was delighted to hear the good news: “It really could be anyone who’s won, since we have a real mix of locals and tourists who shop with us every day.” It later emerged that it was a European tourist who won the prize.

• LOUISE Ní Mhuircheartaigh produced a stunning display and shot 1-10 as Kerry ladies took another major step towards ending their famine as they booked their place in the TG4 All-Ireland final for the second year in a row.

There was a huge Kerry crowd in Semple Stadium in Thurles for the semi-final against Mayo which they won by 1-16 t0 1-11.

• THE Kerry footballers suffered heartbreak against Dublin once again as they were beaten in the All-Ireland Final in Croke Park on July 30.

A rainy day in Dublin was the setting for Kerry’s defeat at the hands of our great rivals and there was disappointment on the faces of the many, many thousands of Kerry fans who made the trip to the capital.

• THE Tralee Food Festival provided the best advert for the town seen in years.

The weather was ideal, the spread of the food stands between The Square/Dominick Street and the Island of Geese worked a treat and the family atmosphere all combined to make it the best food festival to date and a great platform to build on for 2024.

Ken Tobin of the Tralee Food Festival said they were delighted with how things panned out. “It’s been an overwhelming success, we’re incredibly happy with the crowds of people who have shown up over the two days,” he said.

• THE Rose of Tralee International Festival announced it would not be organising a Rose Ball or financing street entertainment for the festival in August.

In a statement issued  in late May on their website, the Festival’s Executive Chairman, Anthony O’Gara, did confirm that the Rose of Tralee selections would be broadcast live from MTU’s Kerry Sports Academy again.

The reason cited for discontinuing support for street entertainment is due to rising running costs and financial support not increasing over the past decade.

However, Kerry County Council said they would work with the business community to ensure there were family events and activities on the streets of Tralee during the Rose of Tralee Festival.

If anyone has any items that they would like to share with us, we would greatly appreciate anything of interest as we are trying to create a collage of memories from the past 50 years of our fantastic club. Thanking you in advance.

We are aware these items are of sentimental value to families, so we will only be requesting copies of photos, the facility is also available to scan newsletters/Programmes etc. if required.

The owners will always keep the originals. Any enquiries/items can be emailed to pro.stpatricksblennerville.kerry@gaa.ie or for collection of items Sharon 0879712665

Review of u18 girls team’s season: There is not a lot of competition for u18 girls but there was a County League which they did very well in. In a very close Division 2 final they lost out to Beaufort.

Review of u15 boys team’s season: Our U15 team had a fantastic 2023 season. The year began at the end of January when training commenced in the MTU under lights on the Astro pitch and Sunday mornings in Na Gaeil.

Numbers were great with thirty-five players in total and this enabled us to have two teams playing competitive football. We entered Co. League, Central Region and also Town League. Our U15A team won the Co. League Division 2 and our U15B team reached the semi-final in their division.

Likewise in the Central Region our A team reached the Division 1 semi-final and our B team were competitive in all their group games. One team was entered in the Town League where we also reached the Division 1 semi-final.

We also reached the cup final in the Lee Strand U14 blitz for the first time ever, losing out marginally to Oranmore from Galway. Our U15 players were also well represented in the St. Brendans U15 championship team where we had thirteen players involved in the panel and four to five regular starters.

They went on to win the Shield in the Co. Championship. Unfortunately in Féile this year we did not do as well as we had hoped but our lads still enjoyed the experience of taking part in the competition.

We had one player starting on the U14 North Kerry Development squad and two in the extended panel. We also had Spar sponsor our new set of jerseys due to the second team so huge thanks to Louis Byrne for that.

We also had very generous sponsors within our U15 group that enabled our players to purchase the new club half zip hoodie for just fifteen euro. Thanks again to our sponsors. As a management team we felt the year was a huge success as every young player got to play competitive football matches with numbers strong enough to support two teams.

Our ethos for the year was to learn by playing and we hope every player enjoyed their year.

PHOTOS: All The Fun Of The Christmas Day Swim In Fenit

.

Seasoned Fenit Christmas Day swimmer, Billy Ryle, describes the atmosphere at the tradition on Monday…

An overcast but (mostly) dry Fenit was a virtual winter wonderland of song, music, laughter and revelry on Christmas morning as the picturesque village hosted the annual Christmas Day swim in ideal conditions.

The wonderful tradition of the Yuletide swim in Fenit was inaugurated in 1952 and has since grown to be one of the best attended swims in the country.

The huge crowd of people began to converge by the roadway and greenway on Fenit village from 11am for the noon swim with around 700 people of all ages taking part and around the same number watching on.

.

All the regular Christmas Day swimmers, as well as the hardy annual plungers, were present to take part with the buzz of excitement and giddy anticipation tangible among the gathering in the car park.

Members of RNLI Fenit served up a variety of seasonal refreshments while the assembling numbers were entertained with songs and revelry.

The atmosphere was electric as the swimmers lined up on the beach at 11.55am for a lively rendition of Jingle Bells.

Santa and Mrs Claus quickly had the enthusiastic swimmers under starters orders for the traditional charge to the sea at noon.

The early morning rain, which looked as if it might put a damper on proceedings, had obligingly moved on and the incoming tide looked very inviting with a gentle tidal roll.

The majority of swimmers did the customary three charges into the sea. All the swimmers behaved sensibly and got in, got down, got out and got warm.

The RNLI Lifeboat was also anchored off shore to provide safety cover and to sound the gong for the charge to the sea.

Many people home for Christmas turned up to be part of a wonderful occasion. A substantial cohort of first timers and young swimmers also took the plunge into the pleasantly temperate sea.

The large collection went to RNLI Fenit, whose members were in position with their collection boxes from 11am and were generously supported by the festive crowd.

The RNLI also provided piping hot soup, tea and coffee for one and all throughout the day. The warm refreshments went down a treat after the swim.

Then it was time to head home for a hot shower before tucking in to the turkey and ham. The appetite for the traditional fare had been nicely whetted by another unforgettable Christmas Day swim. Long may the tradition continue and may we have the health to enjoy it! Scroll down for photos…

A KERRY businessman spread some Christmas cheer to children at University Hospital Kerry on Christmas Day.

Kevin Ross of Balloons le Grá, the balloon business with stores in Manor West Shopping Centre, Abbeyfeale and Arthur’s Quay Shopping Centre in Limerick City took the initiative to visit UHK to bring smiles to the faces of children who couldn’t be home for Christmas.

Kevin and a few members of his team handed out festive balloons to the children at the hospital.  Kevin made special stops at the Cashel ward (children’s ward) and Emily ward (neonatal), where the newest members of the community are welcomed into the world.

The aim was not only to put a smile on the faces of the little ones but also to bring comfort and joy to the new moms and dads who couldn’t bring their little ones home for Christmas.

“It’s only something small, even if I had only seen one child smile today, I was happy,” said Kevin. “I’d like to say a huge thanks to Mary Fitzgerald, General Manager of UHK, for approving this. It certainly brought smiles, so that’s good enough for me.”

The information panel, which is in both Irish and English, is located adjacent to the playground and the entrance to the new greenway. It’s divided into three sections, with the first giving a brief history of St Brendan and beginning of a timeline of his life.

The second panel gives information on the statue of St Brendan which overlooks the entrance to Fenit Harbour, while the third section concerns the St Brendan Way.

• SINN Féin Party President Mary Lou McDonald delivered the main address at the centenary commemoration of the Ballyseedy Massacre on Sunday March 5 at the famous monument outside Tralee.

IT’S a Christmas tradition now.

The beautiful collective voice of the Curraheen Choir could be heard on Friday evening outside O’Shea’s Gala in Blennerville as they sang Christmas carols for a great cause.

The Choir has raised thousands of euro since they started the fundraiser for St Vincent de Paul around eight years ago. The choir sang from 5pm to 6.30pm for the great cause and customers slotted their cash into the donation point.

Kieran and Mary O’Shea of O’Shea’s Gala, along with the choir, thanked their customers for the generosity shown to the charity.
